When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. 

When you browse our store, we also automatically receive your computer’s internet protocol (ip) address in order to provide us with information that helps us learn about your browser and operating system. 

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates. 

Text marketing (if applicable): With your permission, we may send text messages about our store, new products, and other updates. Updates include checkout reminders. webhooks will be used to trigger the checkout reminders messaging system.

How Do You Get My Consent?

when you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

We may disclose your personal information if we are required by law to do so or if you violate our terms of service.

Section 4 - Shopify

Our store is hosted on Shopify inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through shopify’s data storage, databases and the general shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then shopify stores your credit card data. It is encrypted through the payment card industry data security standard (pci-dss). your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by pci-dss as managed by the PCI security standards council, which is a joint effort of brands like visa, mastercard, american express and discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Section 5 - Third-Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United states, then your personal information used in completing that transaction may be subject to disclosure under United states legislation, including the patriot act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this privacy policy or our website’s terms of service.

Section 6 - Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (ssl) and stored with aes-256 encryption. Although no method of transmission over the internet or electronic storage is 100% secure, we follow all pci-dss requirements and implement additional generally accepted industry standards.

_session_id, unique token, session, allows shopify to store information about your session (referrer, landing page, etc).

_shopify_visit, no data held, persistent for 30 minutes from the last visit, used by our website provider’s internal stats tracker to record the number of visits

_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, stores information about the contents of your cart.

_secure_session_id, unique token, sessional

storefront_digest, unique token, indefinite if the shop has a password, this is used to determine if the current visitor has access.

Section 8 - Age Of Consent

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Section 9 - Changes To This Privacy Policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

Section 10 - SMS/MMS Mobile Message Marketing Program Terms And Conditions

The Stockplace (hereinafter, “we,” “us,” “our”) is offering a mobile messaging program (the “program”), which you agree to use and participate in subject to these mobile messaging terms and conditions and privacy policy (the “agreement”). By opting in to or participating in any of our programs, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “dispute resolution” section below. This agreement is limited to the program and is not intended to modify other terms and conditions or privacy policy that may govern the relationship between you and us in other contexts.

User Opt In: The program allows users to receive sms/mms mobile messages by affirmatively opting into the program, such as through online or application-based enrollment forms. regardless of the opt-in method you utilized to join the program, you agree that this agreement applies to your participation in the program.

By participating in the program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from us. Our Disclaimer Of Warranty: The program is offered on an "as-is" basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this program. delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of our control. T-Mobile is not liable for delayed or undelivered mobile messages.

Participant Requirements: You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

Age Restriction: You may not use or engage with the platform if you are under thirteen (13) years of age. If you use or engage with the platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so. By using or engaging with the platform, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18) and have your parent’s or legal guardian’s permission to use or engage with the platform, or are of adult age in your jurisdiction. By using or engaging with the platform, you also acknowledge and agree that you are permitted by your jurisdiction’s applicable law to use and/or engage with the platform.

Prohibited Content: You acknowledge and agree to not send any prohibited content over the platform. prohibited content includes:

  • any fraudulent, libelous, defamatory, scandalous, threatening, harassing, or stalking activity;
  • objectionable content, including profanity, obscenity, lasciviousness, violence, bigotry, hatred, and discrimination on the basis of race, sex, religion, nationality, disability, sexual orientation, or age;
  • pirated computer programs, viruses, worms, trojan horses, or other harmful code;
  • any product, service, or promotion that is unlawful where such product, service, or promotion thereof is received;
  • any content that implicates and/or references personal health information that is protected by the health insurance portability and accountability act (“hipaa”) or the health information technology for economic and clinical health act (“hitec” act); and
  • any other content that is prohibited by applicable law in the jurisdiction from which the message is sent.

Dispute Resolution: In the event that there is a dispute, claim, or controversy between you and us, or between you any other third-party service provider acting on our behalf to transmit the mobile messages within the scope of the program, arising out of or relating to federal or state statutory claims, common law claims, this agreement, or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, such dispute, claim, or controversy will be, to the fullest extent permitted by law, determined by arbitration in Sandy, Utah before one arbitrator.

The parties agree to submit the dispute to binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association (“AAA”) then in effect. except as otherwise provided herein, the arbitrator shall apply the substantive laws of the federal judicial circuit in which The Stockplace’s principal place of business is located, without regard to its conflict of laws rules. Within ten (10) calendar days after the arbitration demand is served upon a party, the parties must jointly select an arbitrator with at least five years’ experience in that capacity and who has knowledge of and experience with the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, a party may petition the aaa to appoint an arbitrator, who must satisfy the same experience requirement.

In the event of a dispute, the arbitrator shall decide the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (“FAA”). The parties also agree that the aaa’s rules governing emergency measures of protection shall apply in lieu of seeking emergency injunctive relief from a court. The decision of the arbitrator shall be final and binding, and no party shall have rights of appeal except for those provided in section 10 of the FAA.

Each party shall bear its share of the fees paid for the arbitrator and the administration of the arbitration; however, the arbitrator shall have the power to order one party to pay all or any portion of such fees as part of a well-reasoned decision. The parties agree that the arbitrator shall have the authority to award attorneys’ fees only to the extent expressly authorized by statute or contract. The arbitrator shall have no authority to award punitive damages and each party hereby waives any right to seek or recover punitive damages with respect to any dispute resolved by arbitration.

The parties agree to arbitrate solely on an individual basis, and this agreement does not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding.

Except as may be required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. If any term or provision of this section is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this section or invalidate or render unenforceable such term or provision in any other jurisdiction.

If for any reason a dispute proceeds in court rather than in arbitration, the parties hereby waive any right to a jury trial. This arbitration provision shall survive any cancellation or termination of your agreement to participate in any of our programs.

Miscellaneous: You warrant and represent to us that you have all necessary rights, power, and authority to agree to these terms and perform your obligations hereunder, and nothing contained in this agreement or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder.

If any provision of this agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this agreement will otherwise remain in full force and effect and enforceable. Any new features, changes, updates or improvements of the program shall be subject to this agreement unless explicitly stated otherwise in writing.

We reserve the right to change this agreement from time to time. any updates to this agreement shall be communicated to you. You acknowledge your responsibility to review this agreement from time to time and to be aware of any such changes.By continuing to participate in the program after any such changes, you accept this agreement, as modified.

How Returns Work

All returns must be unworn and unwashed, and must be requested within 14 days of delivery. Please include your original sales receipt and all order information so we can process your return promptly and correctly.

We offer pre-paid shipping labels to conveniently drop at your post office. By selecting Redo at checkout, your return label will be free. If it is not selected, the cost of the label will be deducted from your return amount.

Policy Specifics

Sale Items: All purchases marked "sale" are final sale. No exceptions will be made. This includes items purchased during a flash sale.

Shoes: All shoes must be returned in their original shoebox and placed inside an additional protective shipping box. Please do not put postage stickers directly on the original shoebox.

Swim: All swimwear must have the sanitary strip still in place, or the item will not be eligible for return.

Returns Shipping: Shipping costs are non-refundable. If you receive a return shipping label, $7.95 will be deducted from your return. We are not responsible for any returned items that are lost in transit. Please keep your tracking information. In-person returns will not be accepted.

Damaged Items: All damaged items must be reported within 5 days of receiving the item to be eligible for a replacement or resolution.Each resolution is on a per case basis. You may be eligible for a percentage of a refund or full refund depending on the severity of damage and wearability. If the item was washed and shrunk, we are not responsible.

Orders Placed on Instagram or Facebook: Orders placed via the new Instagram + Facebook Checkout feature are eligible for a refund up to 30 days after being placed.

All other return policies as seen above apply. Items returned that do not adhere to our policies will be returned to sender and no credit will be issued. 

FAQs

What is the return window?

Within 14 days of receiving your order that you want to return, you must submit a return request. Once approved, quickly send it back to receive your refund/exchange.

How long does it take for my return to process?

When you request, it will take 1-5 days for approval. Once we receive your return, allow up to 14 days for it to be fully processed.

Can I get a refund for an order I paid with store credit?

No, you can only exchange or be re-issued store credit.

What counts as a damaged item?

An item with major defects that make it unwearable, like being drastically damaged or stained. The following do not count as damage: a loose string, wrinkles, shrinking after washing.
